Terms of Service & Privacy Policy

These terms apply to all products and services operated by Mighty Spatial, including the IFC to GIS web converter at mightyspatial.com/convert and the associated REST API.
Terms of Service
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Mighty Spatial, a sole trader business operated by Rahman Sobbi under the laws of Australia (ABN holder), with principal place of business in New South Wales, Australia (“Mighty Spatial”, “we”, “us”, or “our”).
By accessing or using the Mighty Spatial website, the IFC to GIS conversion tool (“Converter”), the REST API (“API”), or any related services (collectively, the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
The Service is provided as a tool for converting Industry Foundation Classes (IFC) Building Information Modelling (BIM) files into Geographic Information System (GIS) formats, including but not limited to GeoJSON, GeoPackage, Shapefile, and File Geodatabase. The free tier of the Service is provided at no cost and may be subject to usage limitations. Paid tiers are subject to additional terms as set out in the applicable subscription or purchase agreement.
Disclaimer of Warranties
IMPORTANT: Please read this section carefully. It limits the warranties provided in connection with the Service.
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
Without limiting the foregoing, Mighty Spatial does not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free;
- The results obtained from the Service will be accurate, reliable, or complete;
- The quality of any converted files, data, or other output obtained through the Service will meet your requirements or expectations;
- Coordinate reference systems (CRS) will be correctly detected, preserved, or transformed during conversion;
- Geometry will be preserved without simplification, distortion, or loss during the conversion process;
- All IFC properties, attributes, relationships, or metadata will be fully and accurately transferred to the output format;
- The output will be compatible with all GIS software or meet the requirements of any particular standard or specification.
To the maximum extent permitted by applicable law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), Mighty Spatial expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service. Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee or right that cannot be excluded, restricted, or modified under the Australian Consumer Law or other applicable legislation.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MIGHTY SPATIAL, ITS PROPRIETOR, EMPLOYEES, AGENTS, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, BUSINESS INTERRUPTION, COST OF SUBSTITUTE SERVICES, OR ANY DAMAGES ARISING FROM OR RELATED TO:
- Your use of or inability to use the Service;
- Any errors, inaccuracies, or omissions in converted data or output files;
- Decisions made or actions taken in reliance on the output of the Service;
- Incorrect coordinate reference system detection or transformation;
- Loss or corruption of uploaded files during processing;
- Unauthorised access to or alteration of your data during transmission;
- Any matter relating to the Service, regardless of the legal theory upon which the claim is based.
IN NO EVENT SHALL MIGHTY SPATIAL’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO MIGHTY SPATIAL IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100).
For users of the free tier who have not paid any fees, Mighty Spatial’s total aggregate liability shall not exceed AUD $100.
The limitations in this section apply even if Mighty Spatial has been advised of the possibility of such damages and regardless of whether the remedy fails of its essential purpose.
Accuracy & Spatial Data Disclaimer
CRITICAL: The output of the Service must not be used as the sole source of truth for safety-critical applications, including but not limited to construction, surveying, navigation, emergency management, or infrastructure engineering.
The conversion of data between IFC (BIM) and GIS formats involves inherent technical challenges and potential sources of error. Users must be aware of and accept the following limitations:
Coordinate Reference Systems (CRS)
The Service attempts to automatically detect the coordinate reference system of the input IFC file. This auto-detection relies on metadata embedded within the file and may be incorrect, incomplete, or unavailable. Where CRS information is absent or ambiguous, the Service may apply a default CRS that does not correspond to the actual spatial reference of the data. Users are solely responsible for verifying and, where necessary, correcting the CRS of all output data.
Geometry Conversion
The conversion process may involve tessellation, simplification, or approximation of complex 3D BIM geometry for representation in GIS formats. Curved surfaces may be faceted; solid geometry may be converted to boundary representations; complex boolean operations may produce approximated results. The geometric fidelity of the output is not guaranteed to be identical to the source.
Property and Attribute Transfer
While the Service endeavours to preserve IFC properties and attributes in the output, not all IFC property sets, quantity sets, or relationship structures may be representable in the target GIS format. Data loss, truncation, or restructuring may occur, particularly with complex IFC data structures.
Independent Verification Required
All output from the Service should be independently verified by qualified professionals before being used for any purpose, including but not limited to:
- Construction planning, setout, or as-built documentation;
- Land surveying, cadastral, or boundary determination purposes;
- Engineering design or structural analysis;
- Regulatory compliance or permit applications;
- Infrastructure asset management or maintenance planning;
- Emergency management or safety-critical operations;
- Environmental impact assessment or monitoring.
Mighty Spatial accepts no responsibility for any loss, damage, or liability arising from the use of conversion output without independent verification by appropriately qualified persons.
Data Handling & Privacy
Mighty Spatial is committed to protecting the privacy and confidentiality of your data. This section describes how files and data are handled when you use the Service.
File Processing
When you upload an IFC file to the Service, it is transmitted via encrypted connection (HTTPS/TLS) to our servers for processing. Files are processed server-side in an isolated environment.
File Retention and Deletion
- Uploaded input files and generated output files are temporarily cached on our servers for a maximum period of ten (10) minutes following the completion of processing;
- After the cache period expires, all files (both input and output) are automatically and permanently deleted from our servers;
- No copies, backups, or archives of your files are retained beyond the cache period;
- We do not access, inspect, or analyse the content of your files for any purpose other than performing the requested conversion.
Free Tier
The free tier of the Service does not require account creation or the provision of any personal information. No personal data is collected, stored, or processed in connection with free tier usage.
Paid Tier and API Access
Users who subscribe to a paid tier or request API access will be required to provide certain personal information, including but not limited to an email address and payment details. API keys are issued to authenticate requests and are associated with user accounts. We store API keys securely and use them solely for the purpose of authenticating and managing your access to the Service. Payment processing is handled by third-party payment processors; Mighty Spatial does not store full credit card or payment account numbers.
API Terms of Use
The following additional terms apply to use of the Mighty Spatial REST API:
API Access
Access to the API is provided via API keys. You are responsible for maintaining the security and confidentiality of your API keys. You must not share, publish, or embed API keys in publicly accessible code repositories or client-side applications. Any use of the API through your API key is deemed to be your use and your responsibility.
Rate Limits and Fair Use
API usage is subject to rate limits and fair use policies as specified in the applicable tier documentation. Mighty Spatial reserves the right to throttle, suspend, or terminate API access in the event of excessive or abusive usage patterns, including but not limited to automated scraping, denial-of-service behaviour, or usage that materially degrades the Service for other users.
Service Level
No service level agreement (SLA) is provided for the free tier of the API. The API is provided on a best-efforts basis and may be subject to downtime, maintenance windows, or service interruptions without prior notice. Paid tiers may include SLA commitments as specified in the applicable subscription agreement.
Modification and Discontinuation
Mighty Spatial reserves the right to modify, deprecate, or discontinue any part of the API at any time, with or without notice. While we will endeavour to provide reasonable notice of material changes, we are not obligated to maintain backward compatibility or continue to support deprecated endpoints.
Intellectual Property
Your Content
You retain all ownership rights in and to any files, data, or content that you upload to or process through the Service (“Your Content”). By using the Service, you grant Mighty Spatial a limited, non-exclusive, royalty-free licence to process Your Content solely for the purpose of providing the Service to you. This licence terminates upon the deletion of Your Content from our servers.
Our Platform
The Service, including all software, algorithms, user interfaces, designs, documentation, APIs, and related intellectual property, is owned by Mighty Spatial and is protected by copyright, trade secret, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use the Service in accordance with these Terms.
Feedback
If you provide any feedback, suggestions, or ideas regarding the Service (“Feedback”), you grant Mighty Spatial an unrestricted, irrevocable, perpetual, royalty-free licence to use, modify, and incorporate such Feedback into the Service without obligation or compensation to you.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law principles.
Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, and you irrevocably submit to the jurisdiction of those courts.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation which cannot lawfully be excluded or limited. This includes the Australian Consumer Law, which contains guarantees that cannot be excluded, restricted, or modified by contract.
Privacy Policy
This Privacy Policy describes how Mighty Spatial collects, uses, and handles your information when you use the Service. We are committed to minimising data collection and protecting your privacy.
Information We Collect
Free Tier Users: We do not collect any personal information from free tier users. No account creation, email address, or personally identifiable information is required to use the free conversion tool. The only data we receive is the IFC file you upload for conversion.
Paid Tier / API Users: We collect the following information from users who subscribe to a paid tier or register for API access:
- Email address (for account management and communication);
- Payment information (processed securely by our third-party payment processor; we do not store full card numbers);
- API usage logs (request timestamps, endpoints accessed, response codes, and file sizes for operational and billing purposes).
How Your Files Are Handled
- Files are uploaded over an encrypted connection (HTTPS/TLS);
- Files are processed in isolated server-side environments;
- Both uploaded and converted files are temporarily cached for a maximum of 10 minutes;
- After the cache period, all files are automatically and permanently deleted;
- We do not retain, copy, archive, or back up your files beyond the cache period;
- We do not use your files for training, analytics, or any purpose other than performing the conversion you requested.
Cookies and Tracking
The Mighty Spatial website uses only essential, strictly necessary cookies required for the operation of the Service (such as session management). We do not use advertising cookies, third-party tracking pixels, or behavioural analytics tools. We may use privacy-respecting, cookie-free analytics (such as server-side request logging) to understand aggregate usage patterns; this data is not linked to individual users.
Third-Party Services
We may use the following categories of third-party services in connection with the operation of the Service:
- Cloud hosting and infrastructure providers (for file processing and serving);
- Payment processors (for handling paid tier subscriptions);
- Email service providers (for transactional communications with paid tier users).
We do not sell, rent, or share your personal information with third parties for marketing purposes.
Data Retention
- Uploaded and converted files: retained for a maximum of 10 minutes, then automatically deleted;
- Account data (paid tier): retained for the duration of your subscription and for a reasonable period thereafter as required for billing, legal, or regulatory purposes;
- API usage logs: retained for up to 90 days for operational purposes.
Your Rights
Depending on your jurisdiction, you may have the following rights in relation to your personal data:
- The right to access, correct, or delete your personal data;
- The right to restrict or object to processing of your personal data;
- The right to data portability;
- The right to withdraw consent at any time (where processing is based on consent);
- The right to lodge a complaint with a supervisory authority.

GDPR Compliance (European Union Users)
If you are located in the European Economic Area (EEA) or the United Kingdom, the General Data Protection Regulation (GDPR) and UK GDPR apply to the processing of your personal data. The lawful bases for processing your data are:
- Contract performance: Processing necessary to provide you with the Service you have requested;
- Legitimate interests: Processing necessary for our legitimate interests (such as preventing fraud, ensuring network security, and improving the Service), provided these interests are not overridden by your data protection rights;
- Legal obligation: Processing necessary to comply with legal requirements.
Where your data is transferred outside the EEA, we ensure appropriate safeguards are in place in accordance with GDPR requirements. You have the right to lodge a complaint with your local data protection supervisory authority.
Australian Privacy Act
Mighty Spatial handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) to the extent that they apply. As a sole trader, Mighty Spatial may be exempt from certain obligations under the Privacy Act; however, we voluntarily adopt best practices for the handling and protection of personal information.
Changes to These Terms
Mighty Spatial reserves the right to modify or update these Terms at any time at its sole discretion. Material changes will be indicated by updating the “Last updated” date at the top of this page. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue use of the Service.
